Acceptable Use Policy (AUP)

This document sets the policy for fair and reasonable use of the services provided by Darkpoint Technology Ltd., and what steps we may take with customers who abuse these services or other users of the net.

Details regarding how to complain about a breach of this AUP can be found at the end of this document.

Basic policy:

Customers may use Darkpoint Technology Ltd. services for their own legal purposes as they wish so long as they do not abuse or damage other net users or services.
The Directors of Darkpoint Technology Ltd. would additionally like to state that above all, it would not approve of any activity that would be tricky to explain to their mother.
Darkpoint Technology Ltd. would like to remind all customers to please keep the Internet a generally happy place.

Mailing Lists:

Customers of Darkpoint Technology Ltd. may maintain mailing lists and send mail to those who have agreed to receive it via an opt-in mailing list.
Mailing lists must have identifiable contact and removal instructions contained within the body of each message sent to the list.
Darkpoint Technology ltd. reserves the right to request logs or other proof to confirm that all users have requested to be part of any mailing list hosted.

Discussion Boards:

Administrators of Discussion boards will maintain each board to the best of there abilities.
Darkpoint Technology expects administrators to carry out this duty fairly, and to resolve all disputes quickly and effectively.

Users: Please post responsibly, you will be held accountable for all posts and all posts that are made with your username.
This means that you will be held accountable to the same rules as site administrators.
In summary, you should play nicely, and not do anything that is offensive. Please consider your actions.
All posts and other related material is copyrighted to the poster.

Darkpoint Technology will step in if it is felt that the overall AUP has not been followed by Posters or Site Administrators, or Discussion Board Administrators.
In extreme cases this action could include, banning of users, demoting of Discussion Board Administrators, too the complete withdraw of a discussion board.

Misuse of Services:

Customers of Darkpoint Technology Ltd. may not:
          Mail bomb or harass other net users (by email or other means);
          Send unsolicited mail ("spam"), chain letters or pyramid selling schemes from or via Darkpoint Technology Ltd. facilities;
          Send inappropriate or repeated messages (Usenet spam) to news groups;
          Use Darkpoint Technology Ltd. to collect responses from spam;
          Advertise web sites using spam;
          Offer spamming services or software;
          Modify mail headers so as to impersonate other net users with intent to mislead or deceive.
          Customers may not use Darkpoint Technology Ltd. facilities to break into or to interfere with the operation of other computer systems, or break Darkpoint Technology Ltd. system security, or alter or delete the data of other Darkpoint Technology Ltd. users. This includes, port scanning (using nmap, Retina etc.)
          Customers may not sell on Darkpoint Technology Ltd. services to third parties without the prior written agreement.

Customers may not use Darkpoint Technology Ltd. facilities for any purposes which are illegal under English law. This includes:
          The hosting and distribution of pirated software (warez).
          The hosting of pornographic material.
          The hosting or distribution of any other material (for example music or video files) for which you are not the copyright holder, or for which you do not have the permission of the actual copyright holder.

Excessive Usage:

On any Darkpoint Technology Ltd. server where your services resides, we stipulate that you may use a 'reasonable' amount of the server's resources (e.g. disk, CPU, memory and bandwidth).
In the case where excessive usage of any one or more of these items by a single person, site or script occurs we may take action to prevent detrimental effects to other users. We will take every practical step to notify the end user in this case. (For the avoidance of doubt, 'reasonable' is defined on a per case basis by a senior member of our technical staff.)

Actions Darkpoint Technology Ltd. may take:

Darkpoint Technology Ltd. may take whatever action they see fit to prevent abuse of our facilities, including suspension or deletion of the abusing customers' account and services. No refund of fees already paid will be given in such cases. Darkpoint Technology Ltd. reserves the right to make an additional charge of £500, or actual cost if greater, to cover the work done in identifying and recovering from such abuse.

Copyright:

Customers must ensure that they hold the copyright, or have permission of the copyright holder, for all material on their web pages. Any material for which the copyright status is in doubt may be removed until its status has been clarified.

Customers' Personal Details:

Darkpoint Technology Ltd. will not reveal personal details of our customers to any other party except where required to do so by law, or if requested to do so by police or other government authorities investigating illegal activities.

Darkpoint Technology Ltd. may also provide information needed by other service providers investigating abuse of their services, but this will only include information essential to this task.

Cookies:

Darkpoint Technology Ltd. makes no use of cookies as a method to track its customers surfing habits.

Cookies are enabled as part of discussion boards, as part of user authentication. Thus saving any user from having to re-enter their password every time they change pages.
This use is restricted to the discussion boards, and the information gained is only used to improve the realtime user experience, and not to provide any tracking of the user.

Report Abuse:

If you feel any part of Darkpoint Technology Ltd's AUP has been breached by any of our customers, please email our staff who deal with incidents of this nature on the following email address:

Please include as much information as possible so that any incidents can be investigated quickly and efficiently.

Darkpoint Technology Ltd. reserves the right to make changes to this policy. Existing customers will be notified of all changes.
